Sweating it out in the Noticeable Discomfort Zone

LOL so how did I get the humidity up. Three Tin Cans filled with water on top of the radiator. Go Green, no electricity, recycling. I can bring the humidity up to perfect pitch 46 by taking a shower. However sadly with the high temperature we are still at noticeable discomfot.

They ignored my letter that corrected all of their bill errors.
So we should be on par with our rent right?
First off we know the lease has been changed, they changed the rent among a host of illegalities. The pages that have no initials are changed.
My rent is $1100, the two months deposit and all the rents paid verify that rent.
It doesn't matter what they changed, deductions, credits. These are not plain language, or legal lease language.
I went to a lawyer months ago with my lease. He could not understand the lease. I had to explain it. Then I said the judge will have quite the giggle its entirely illegal. They will not get far in any case where this document is present.
So here we have the bottom line on this post.
Todays bill states that my rent is now $1400 and that I owe $255 in arrears. I have been here 8 months and there are 11 checks each for $1100. Do the math?
Just another item of harassment as so far not knowing what the shoe thing again Governor of this state has conjured up for his subjects you cannot just change the lease amount month to month upon your whim or poor math skills.

I have been struggling with a problem
When I let the property manager know that no diatemaceous soil placement or any checkup on the apartment I reside in had occurred and there was some bug, do not know if its bed bug that is causing irritations to my scalp.
The property manager wrote back to quit calling wolf and that there were no bed bugs in my apartment. He said if I wish to move I could do so without penalty.
I have the pictures of all my whelps during this period of time. Actually the iphone pictures were lost because well AT&T's software crashed that item. Geekboy pays for my iphone. LOL do you think my unemployment of $60 a week could?
I took pictures of the bug invasion and was able to bag some of the bugs. During this time Medicaid and I were fighting so that I could have healthcare enough to get help with the whelps. I was not able to get the care I needed. Finally when I saw the dermatologist, month later he was frivolous with the appointment proclaiming what a healthy flawless person I was. It took me two more months to get the new dermatologist. In between I saw an allergist who proclaimed there were no allergy tests for bed bugs. The new dermatologist stated that the allergist was wrong that there were tests.
My new dermatologist stated that anytime that I thought there were bug problems to come on in and they will see me immediately. That's a relief.
My primary physician was so consumed with the breast cancer that she thought I had because of the negligent imaging center that she would not listen to anything i was telling or asking her. She poohed my foot doctor and rolled her eyes about the allergy and dermatologist.
Actually the allergy and dermatologist are most useful. They bonafide proved that I have high allergies to bed bugs, roaches, dust mites and sulfa, and aromatic amines (meaning cigarette smoke). The 22 needle test of the allergist was a great control for me. I took pictures of it. You can put those pictures side by side with the pictures of my whelps from the bed bugs.
Why bed bugs and not just a cockroach? Well the cockroaches that were found in this apartment were in the emptied closet and on the wall next to the musician far away from my bed. There was one outside the at the time empty apartment next door, an apartment the landlord could have easily offered to get away from immediate harm from the bed bug extermination. He did not, he ignored me. No small cockroaches have been seen or found. The cockroaches I speak of are huge, they are tree cockroaches.
Most importantly though, a bed bug beagle was brought in to inspect apartments in the building. That is why 311 would not be able to help me as the landlord was taking steps.
The bed bug beagle identified the end of my leather sofa bed as having bed bugs and the docile bloodshot eyed dog also barked at me. At that time I was experiencing the scalp irritations. The dermatologist did a biopsy on my scalp and quaified the irritations of my scalp. If PPD were a problem with my couch would I have had scalp irritations years before? The couch is a few years old. I did not. I received my first whelp within a month of living in this apartment. At that time I took all my clothes out of the closet and washed them and put them in plastic clothes bags. I steamed the closet in its entirety as it smelled like what I came to recognize bed bugs. There were reasons for that. The framing around the closet inside and out as well as the bathroom is corroded. Why the property manage hit the bathroom frame and it bounced off, he hit it back on again. This is a haven for bed bugs as well as many significant gaps in the floors, the radiator, the cracks in the seams of the ceiling and floor.
The landlord/property manager promised to take care of his apartment's disrpair in May 2009. Before he exterminated for the bed bugs I asked that 1) he repair these items 2) replace my sofa bed that had been found infected and 3) provide a place for me to be away from an extermination that recommended those with asthmatic conditions be away for a few days. The allergist as well as primary doctor will vouch for asthmatic conditions present in me at this time. The landlord/property manager ignored my requests and their exterminator lied to me and said the extermination was different and asthmatic conditions, well, I need only be away for 4 hours. I was dreadfully ill for a week. I asked them not to spray my sofa bed and they did. The residue and smell was all over the couch. This is the obnoxiousness of a slumlord. They own the courts and they will damn well do what they please!
There is much correspondence re bed bugs between myself and the property manager as well as their numerous flyers. Why the very first conversation I had with the property manager was recorded. I took it to the civil court and they said it was mild harassment. Their response to my question about neighbors coming up to me and warning me to not buy new furniture or put anything on the floor as there were bed bugs was met by the property manager stating move out of our building within 24 hours or suffer the penalty. The penalty? Two years of rent paid immediately.

still you have to see the whole mess of this. That it is incredibly hard to prove your landlord's negligene if you do not have established healthcare. That took a very long time, insurmountable amounts of my time, time where the agencies refused to give me any time off from work to take an appointment. You have physicians just throwing my time away because of their petty personal biases. Even the good dermatologist way overbooks to where my appointments are stretched out to 2-3 hours of waiting. When the appointment actually happens he is too busy to even give me qualified time. This last time they skimmed over everything in a minute.
My scalp is still a raging red. Probably because the excessive heat has brought back the bugs. This time though I can just pop in to the dermatologist after I go get another referral that is. I wonder if that primary physician has got over her breast cancer thing so that we can talk about the problem with my feet and scalp. These are important items. If she cannot I will get a new provider. I still have some time on my account. I will use it very well not in biased waste.

Evident Discomfort the excessive heating issues continue

The apartment therapy has a discussion on toaster apartments in New York City. I can't imagine leaving my window open here, people, large roaches and small mice come on in along with tons of air pollutants and cigarette smokes. The air is not fresh. Humidifier? This apartment tends to be too humid. I have to demold the bathroom every two weeks and have light cleaners everywhere. Its 1:44Am 84.6 degrees and 32 humidity. The heat problem just started five days ago and we've had far colder weather before then without the apartment going toasty. That's why I wrote the landlord. That's about as far the call for help will go. I'm hoping they might fix the toilet that has malfunctioned (requires 6 - 8 flushes per use) since moving in 8 months ago as they said they would and throw a tip about how their radiators run in the building. A musician is entitled to practice time. They are not entitled to abusive practice time such as 11:45pm on a weekday or 1am-5pm with their band on a weekday. Nor are they entitled to continuous 4 hours of such practice at any time. Recording tracks, band rehearsing, playing pieces of your radio show or your musical track or your phone conferences or whatever on your speaker next to the wall and on the floor is clearly not within the realm of being a practicing musician. These are commercial efforts and this building is not so zoned.
If these doughheads had just been in moderation about things with some consideration I would not have had a problem. However, I have submitted a complaint to the HPD two weeks ago about a building zone violation. I have not heard back on this. Just another item to have to deal with a city that really doesn't have its shit together.
For instance, the last four hours of noise have been consumed by undoubtedly illegal concrete drilling in the back of the building that has been shaking my floor. In response to such luxe sound, the musician, having a business conference or editing a radio show on loud speaker has turned up the volume even more. Should I be on a phone conversation with my mom such musician plays even louder as if to drown me out. Heck my mom can't even hear me.
The barking dog owner said just knock on the door and tell them. I said I wrote them a letter detailing what I was experiencing and asked them if they knew the source. They never answered. The response to my letter was playing from 1am -5am in the morning on a weekday, additional band rehearsals starting on a weekday at 11:45pm and as I stated they've been playing their conversation or radio show on a loudspeaker turned up high enough to vibrate my sofabed which is at the opposite wall. That wall we share is vibrating and so is the floor. There is no excuse for such behavior. They drown my life out daily with their sounds.
I am a musician. Everything I do is on headphones, so I really don't get these people at all. I'm incredibly tolerant. The first two months I was like I don't where the sound is coming from. So I just figured it out piece by piece, i.e. their slammed door, the noise stops; entering the building and the music is coming from the stairs and as you enter my apartment the music sounds as if its coming from my apartment. The corner of such apartment vibrates and is loud with the music.
The lease states there is to be consideration of your neighbors as to noise. That noise after 10pm was to be kept down. Such rules may be found in the house rules which every tenant and shareholder residing or renting in this building has signed the house rules alongside the landlord's signature.
The person who owns the coop where this fairly new tenant resides was over the top about noise. The first day I moved in I was venting about the place being outrageously filthy ti was way before 10pm on a weekend evening. The super had told me he had cleaned the apartment when I called him to check. That tenant banged on my door and shouted at me to keep the noise down. She was not a tolerant person.
Compare her to me for I have been incredibly tolerant of her tenants. I have given them undue time to resolve their noise problems. For me the next step is preparing for court, recording the decibels, printing the months long diary and correspondence to tenant, landlord and city and writing that one last letter to all. Their last chance; after 30 days we will be in New York Supreme Court with all the parties and I will win.
Isn't life a joke in New York City.
Ha I keep a diary of these incibels, its the only way to keep it straight.
Just Say No! to Exploitation of Breast Cancer
"Breast Cancer Awareness Month" came about from AstraZeneca, a pharmaceutical company (see Amanda's BlogHer post from yesterday on how drug companies profit from disease marketing) that also manufactures an herbicide known to cause cancer. As other companies jumped on the bandwagon, eager to sell their wares to women who want to do something they can feel good about, the number of products that have links to cancer that are being sold in the name of cancer awareness or even "cures" are concerning. Two prime examples are Revlon, which sponsors a run/walk for breast cancer research and contains high levels of toxic chemicals in some of its products, and Yoplait, whose ubiquitous pink lids must be sent in order for the company to make a donation and who may use dairy products with potentially cancer-causing hormones in them. If you think about it, the logic of buying a bag of pink M&Ms to help prevent breast cancer makes little sense given that obesity increases the risk of breast cancer. LOL I came home with six samples of shampoo since the pharma and medicaid decided to change the prescription to something that was harmful, made my scalp break out and shed large parts of scalp. Yeah that's right my scalp was red so now make it break out and peel off. Nice work losers.
I asked about the reaction to the surgical tape. He said there are way too many ingredients in it to bother with.

Actually the patient, me, loses. I had to wear that patch with surgical tape for two days and the whole time my back was red and itching. The provider didn't know anything about it. They did not wash it off. I had to go another four days until I could wash it off.

Smoking Causes Breast Cancer, Analysis Shows
Gee for my court case, I had collected 3M Filtrettes. These 3M Filtrettes had been systematically applied to a 24" box fan in each room. Pictures were taken of all stages. Where and/or when there was no cigarette smoke (as one of the smokers was away for a week) the filtrette lasted 3 months. (lasted is identified that you hold the filtrette up to the light and can't see through it; it is "exhausted"). Where there was oppressive cigarette smoke the filtrettes lasted all of 3 hours up to 1 week. I put each filtrette in a glad plastic bag and labelled it. I have those filtrettes today and they are in many plastic coverings. I took square inch pieces of such filtrettes to a lab at some steep cost to me. Nicotine was found in the sample. I conferred with 3M and they were surprised I had caught nicotine as they only guarantee 1 and above.

People make money off of it; huge amounts of money. So just stand back and be your own boss and figure it out yourself. Don't let some doctor try to color your world cancer. All you will ever hear in the media or on the painfully selective nyc.gov is the scare story. These are not intelligent or smart people. They have bought their credentials. You need to listen to them and discern. You need to know the real scare story. Then measure it out for yourself, you decide.
I sat in my doctor's office and every great report about my health was weighed down with my doctor's "but they may not have." When I was first in her office before the mammogram I had all positive reports about my blood tests and my asthmas test. I asked her at the time since nothing is panning out about this wheezing thing could I have cancer? I had read that was another source of wheezing. At the time she said no, she said how could you think that, no she never thought that. She gave me a battery of routine tests and I did them. I also asked for allergist and dermatologist and foot doctor. There were concrete reasons for those.
Who knows what I have but I will do the requested tests because its now mud on the wall. I will continue to be careful though of whose care I entrust. So far I have not found such care, they are all bastardized science, so far, all about money and nothing more. I shall not trust them.
None of the women in my family have cancer. I have have never taken hormones and I don't eat meat or dairy products. My only dooming factor is that I live in New York City where it is a smoking city, an oppressive smoking city, your rights to habitability and clean air in your home have been taken away; its clearly rape. Look at your governmental representatives faces in New York City, aren't they an ugly lot. Lies and corruption have a way of doing that to you. No plastic surgeon can erase their crimes.

Complaining about a prescription to the FDA
The pharmacist did not fill the prescription correctly.
Instead of giving me a shampoo they gave me something with 34.5% alcohol and one of the drugs that is included in that shampoo. Within a few hours of applying the "prescription" basically it took a layer of my scalp off.
I take the box to the dermatologist and I say did you prescribe this. He reads it and then he states hey wait a minute, this isn't for scalp this isn't what I prescribed.
I said the pharma took an hour on the phone with Medicaid. Medicaid refused to pay for shampoo. So the pharma changed the prescription without notifying me.
The dermatologist said what is this country coming to, look at the way they are treating you people. lol Let's kick Chuck Schumer out for starters
I'm pretty sure its way too much trouble to file but I'll put this note here and maybe after I put the batteries in my carbon monoxide monitor and figure out why I keep fainting from a radiator whose valve has been closed but keeps the room at 87 and higher.

Ok my primary doctor is trying to convince me I have breast cancer ....
Anyway take it for what its worth. The claim is that black women are more proactive about doing their mammograms. That black women die from breast cancer more than any other race.
The reason why women do not get mammograms is due to inadequate insurance and no insurance provider.

Lol yeah before you turn the volume down on me listen to my why. I did do a mammogram and the imaging center xrayed one side twice. They did not have me wait in the office for the results. They just dumped me back into the same construction worker/disrobed women waiting space for the bone density which totally took 45 minutes. No time frame was given to me. Several weeks later I asked my primary physician so how was the report. They said I had to go get the report. They said that since I had not heard anything everything was fine. I called up the imaging center and I was told the same and they additionally stated that doctor's offices were messed up and they had sent the bone-density test.
I say wait a minute you did not send me the mammography results. Listen here I inadvertently went the same name hospital for the chest xray on a Saturday and they had the results in my doctor's office on the following Monday (all of two days). If they had done the bone density and the mammogram on Saturdays it would be done already. The representative answered that they would send the bone density results again and would speak personally to the radiologist. There were no calls.
One day maybe 7-8 days later I received a letter. We would like you to come in and have additional mammographic views and a sonogram. Even if these results are negative we do not rule out biopsy. When I visited my primary physician she did not have the report in her file. I broke the news to her. She would not take my copy but ask her assistant to get the report.
That's when she gave me the scare routine. I just sat their calmly. LOL I've seen that fat ass routine way too often. I am not a simple person. I know a lot. I particularly know a lot about my body. My body was not going to undergo more radiation under the baboons who last did it. Additionally by this time I had already received a $300 bill for the mammogram from Care Core and a determination letter from Hip/Medicaid. This was not an emergency and this was not authorized.
LMAO baboons for sure. My primary physician ordered this routine test through the Medicaid/HIP system and gave me the referral. I made the appointment and the pre-certified the appointment. When I came in they again precertified and I have the printout from such certification. I remember complaining that their digital signature machine did not let me write REFUSE. Then they pull this shit on me and to boot make me pay for it. I told Medicaid until you get this straight I will not do any more investigations upon my perfect body. I am the one who pursued levels of Medicaid, HIP and Care Core to get that record straight and that was in December that I hope that its finally straight.
LOL and the only thing I know is that my feet hurt and she doesn't care what the foot doctor said. She sneers. He said I have to have both feet operated on and be off of them for eight months. That I already had lost one toe joint and that toe was arthritic and the bone protuberance is also arthritic. Other than that beautiful feet.
Lol she can't say a thing the foot doctor said its totally covered by my insurer because its quality of life. You can say that again. Feet is totally it for me, its everything.
Yeah and all I can think of is I can't get that dang radiator valve to close and its been well over 87 degree F in my apartment for the last few days.

I have this rule not to touch the valve if you don't need to. So all this time I haven't; the temperature was alright up until really maybe Friday. I think because the temperatures are milder outside and maybe some of the people are leaving their windows open? Usually warped windows or open windows cause a radiator to go uzi on the tenants.
Ok guess I have to email those bloomin' landlords repeat valve not shutting down too hot, the refrigerator is ruining my food and the toilet takes anywhere from 5-8 flushes per use. Lol and when I take my clean clothes out of my watertight storage box they smell like tobacco and I'm allergic to it. That will be the eighth letter I have written my landlord.
Ok so I'm sitting there in this doctor's office thinking about the above while my primary doctor going on about breast cancer and she is totally getting upset with me. I'm like this is a very personal issue with her. Her mother died from breast cancer.
Her statistics are way off. She says 1 in 4 women die of breast cancer. LOL not so. Some fact missing with that, not in any of the races does 1 in 4 women die of breast cancer. Breast cancer is #2 (lung cancer #1) for women though.
Yah and what have I written in this blog repeatedly in the past?
That second hand smoke is the #1 cause for breast cancer in women mid-50s and up who are exposed to it. Indeed I was. My overtenant and Landlord would not come and see about the smoke, they refused. They said that smokers have a right to smoke in their apartment. I replied they are smoking in my apartment not theirs. The entire two years I lived in that apartment I was working with the Health Department of New York City, HUD and the civil court. Finally after a year and a half, a bought judge not even reading what was going on with the case said its no sale that the apartment had no value to you. See how they loll about and position it. The case was settled in my favor but that does not mean that there are not other entries there are many significant re-entry points that I became aware of in the last two months. :P losers.
Yep we will be having another round with those defendants but this time they will have a lot of company. So it would behoove me to get this done as we are going to have some real hell going on in civil court for sure over this. I did not need to be spurred on my primary physician. I've been dealing with it, indeed. Struggling with that along with a very long list of things of incredible importance. You know minimum food, a roof over my head.
There were major financial considerations of going forward with this. The fact is the government insurer boldfacely refused to pay for the first mammogram. Imagine a routine mammogram given free to some women. My primary doctor prescribed it. Do get the drift of why women are not getting mammograms besides the very inhumanity of the test and its history. Mammograms killed a group of women because it was misused and now these thugheads are saying the target is now women 40 and over. So women aren't flocking to your death chambers because you are real boobs.
I do not want to give baboons any cancer business. I am practicing smart consumerism and three months is nothing and it wasn't up to me, those baboons did it all by themselves. Oh and you do so have to know that they gave graphs and all sorts of things to my primary physician regarding the state of my mammographies that I did not get. I am going to ask for them. Even the letter that they wrote her was different from the one they wrote me. I can totally understand medicine, its my body and its not yours.
The #1 reason they lost my business: did not give me results within a few hours and xrayed one side twice.
#2 said there was nothing wrong
#3 when asked for the report hemmed and hawed
#4 had to be asked to go get the report #5 billed me triple for one prescribed mammography
#6 along with Care Core, Hip and Medicaid they bullied me like a bill collector
#7 I really did not like their desk and technician bedside manner, it blows.
Yep you are fired! and while I am in court justifiably crucifying The New York State Labor Department I am going to file a case on you too because you are a loser who should really be put out of business.
My primary physician says so you know you have been living with this breast cancer for three months. Its your fault. I'm like not so. I said if they had acted properly this would have been done with and gone, not an issue. But they have not acted properly, not on any score.
I said I was waiting to get the colonscopy done and then I was changing providers. Now I have an unemployment benefits law case coming up and honestly, I can't do both.
I will try but if I get ocular migraine again I am quitting wherever we are.
Just to get the drift of my physicians focus. She wanted to know if I had the pap smear test. Yes three months ago and its in your files. Its fine. She was disbelieving.
Then she wasn't like congratulations on having a great colon she was like did they do the biopsy on that benign polyp. Totally off the wall. Of course they did and it was minute, infinitestimal. .433 mill. Nothing to write home about. That gastro doctor was like this primary phys also. Oh you should have had that six years ago. You probably have polyps the size of a grapefruit. hahaha And the matter is that I did not. I am perfect.
Look I am most interested in quality of life. I do not have quality of life. I have a life that is hell. I do not wish to add bamboons to create yet another hell of billings to figure out for Medicaid/HIP. I am not their accountant, surprise. They should pay me. Losers! I will not tolerate an imaging center that does not give you your results within an hour while you wait. I will not tolerate an imaging center that really doesn't have a doctor available in the office for this second screening.
My friend told me Eastern is good. They told me I need another provider and I can get that one. I will do that sometime tomorrow while giving the New York State Labor Department due hell and of course signing up for Earned Benefits from lovely Seedco with the lovely pack of lies on the latest Benefits sheet. $66 a week my Ass!

This landlord wrote in response to my affirmative reply to his question if there were still bed bugs in my apartment (like aren't you suppose to check?) that I could move out without penalty.
The problem is there are no more $850 or $650 apartments on the market. Manhattan is where you will find the best deals. I've looked everywhere. If you don't have a job you will not get an apartment. That is why these landlords abuse me because they think they have the upper hand. I've contacted HPD and they never show up. Upon followup they say they came and noone was home. There was no note left and I was home. Experience proves they are incredible liars.
So we shall see what happens.
In my entire time in the city there has not ever been one month that I did not pay rent. Landlords have ruthlessly stolen from me but not me from them.
So is my near future a homeless center?
Homeless center couldn't be worse than the Bloomberg years. Here are some of the real shit hole places I've lived in:
$850/month (harlem 135th street, break-ins and police raids every night, no heat, no hot water, racial hate and harassment, repeatedly told they were going to rape me, over 8 roommates, always changing, landlord would keep our mail for days and sometimes not give it us and then it was opened, and of course there is open gun fire quite frequently on the streets);
$650/month (manhattanville, oppressive cigarette smoke, never the same roommates in a 3-month period, overcharged $200/month);
$1200/month Fort George (rats, roaches, oppressive cigarette smoke, warped windows so no heat, breakins nightly, poor subway service)
and
currently $1100/month toilet has never worked (has to be flushed 5 times), refrigerator freezes food and ruins it and makes noises, oppressive cigarette smoke, band rehearsals, barking dog, bed bugs, unpredictable insecticide fumigations, insects.
Lol the beginning of my poverty, Williamsburg $350 you wake up with mice and rats on you and your roommates and landlord are totally off the wall.
The above listed are apartments I rented strictly in the Bloomberg years. Two years in the $650 Manhattanville, 8 months in Central Harlem for $850, Two years in Ft. George and now 8 months in the posh Upper East Side dump.
Where is the City administration in this? Why they are writing the letters to cover their no shows. They spend all day just doing that.
LOL and Mr. Bloomberg only stole the election because fools read the New York Times instead of reading The Best of Trendy. Obama did not even support Mr. Thompson who would have made an excellent mayor. Does that not tell you anything at all?
