I had to pull up the old records and yes the New York State Department of Labor (NYSDOL) had struck again.

For this new claim of regular unemployment I am entitled to a quarter which NYSDOL left empty.

Amusante. I told them on the phone when verifying this claim that a major employer was missing, that they need to include it or the determination will not be correct. The representative took down the information; apparently they did not enter it.

I went through great pain last two claims; considerable un-reimbursed time and expense. I had to write the Commissioner after endless calls on a phone that that had been drowned by MTA - > remember "not a day at the beach"?<>

Now before you go hauling off your holier than thou, through all these claims I mostly worked. This is the first year there was none in all but one quarter (ha! one quarter had plenty of monay but the NYSDOL likes to think of as subjects when in truth they are our public SERVANTS, therefore they left it out and did not proof their work. Most people would be fired; however they remain year after year in their cosy upstate caves. The person I had to fight in Labor Court did everything they could to sabotage employment opportunities from that company. Since they held the client that was willing to employ me there was nothing they could do. The other firm that would love to employ me is reluctant, guilty because they gave me a rejection letter for permanent employment. So there you go. I've been working on a new career for the last six months with the only resource that New York State has given me and we are still hub bubbing over their nonsense. I mean I have over 35 years of being a renter, I've been my own pro se in court knowing full well DHCR rules as well as civil rules, being in both Supreme and Civil court. I have my New York State real estate sale license. I have taken finance and appraisal courses in real estate. You mean duh I can't handle a property management course wrapped up in Sustainability. Give me a break. When I take the paralegal course I will focus it on real estate and finance and get the freakin property management job any way, duh. So thank you very much for continuing to leave me without training for a job.

Anyway, I had to write up the NYSDOL history all up, and copy all the documents and state that this has to be taken care of immediately you are leaving me destitute again. I do believe they get a thrill when torturing people, people who pay their salaries. The representative said ma'am if they give you $10 a week your benefits are still not exhausted; that is unemployment. My aunt said I wonder how she would like that if that happened to her and she had worked as many hours as you have.

My Supreme Court brief for NYSDOL covers (1) failure to perform their job (2) labor judgment that was so petty and illogical that I did not challenge (3) no fine or reimbursement of interest and costs to defend myself against a lying and harassing employer (4) reimbursement for time and labor to do the NYSDOL's job for them this time around (4) "exhaustion" of benefits -- what does it mean -- if things don't perk up here my next claim will face what I am facing today -- poverty beyond the poverty I have already experienced this year.

I should have been put on Emergency Benefits last year, well at least HEAP, food stamps. Sorry darlings you are not offered low cost housing, Section 8 etc etc the waiting list has been closed since 2007 and if we are talking about lotteries those go to police and the disabled. So chump up will you?

Having gone through a horrendous Medicaid battle and seeing what absolute junk it is; I did not want to go through another set of crock. They paid my dermatologist $16 for doing a scalp biopsy, a biopsy required because of my landlord's negligence. However I have no choice, I must. Perhaps if the lame brain agency that gave me the 8 days of work would send me my Copy B I could finish my taxes and be safe for next month? But no I will have to call them and ask them to email me it.

Safe means paying my rent. I am able to do so this month but will have nothing to eat. That's ok I can survive two weeks without eating; I had to do that the last two claims, waiting out this incompetent NYSDOL. Why do lazy people like that have jobs and I don't?

The problem is NYSDOL does not realize that they are our public servants not the other way around. If it were not for us they too would not have a job. So quit being the obnoxious cows that you are, really, shame on you. You did not do your job.

Yes we will get this problem fixed pronto. Last time it took over a month after writing the Commissioner priority mail. Their fault and duh not mine.

They better snap it up this time. Meanwhile I am filing my brief. I have to wait and see who else I'm going to pop. Perhaps the Small Business Division of New York City and HPD and my current landlord and yes HUD. So I plan to do it all in one shove and not waste my money or time. The briefs are here, perfecto. I'm waiting.

Oh I have experience indeed, I took DHCR to that court. Because the lawyer lied to me and said the defendant was going to pay up and also that DHCR would just keep saying they were not ready I said ok just do it. Well I had a job and I would surely lose it if I became a victim of their games. At any rate I did become a victim of their games for it was another year and a half of incredible struggle with them (all told 3 years) before I was able to record the judgment and to date the defendant has not paid. Yes, she has not paid even when DHCR gave her one year to pay on her own recognizance she defaulted every month and paid only two months. The form she signed stated she was not allowed to default but she did and DHCR ignored my warnings each and every time. Finally I slapped a suit on them and they made a judgement in my favor totally cheating me in so many ways. That's why I slapped a PAR and then a NYSup case on them. I had never done a legal case before, it was interesting.

In order to get that brief in through poor person's relief two judges have to read it. They said it was of substance and not frivolous that they do not get quality work like that there. LOL don't I know it, I've worked in huge law firms afterall. Boy they do go on and on about their credentials, but when push comes to shove, lol.

My brief had an issue about discrimination, about a special welfare for people whose economics were not welfare at all, a tax-free welfare that DHCR was providing for this special interest group that was not in the best interest of the citizens of this state.

So back at the ranch with this current landlord. Today its 81.9 degrees inside (30 degrees F outside) and room filled with cigarette smoke. I could not raise my window because there was major illegal construction out in back. LOL what a piece of work. p.s. please note the hall way stairs and my next door neighbor's doors as well as mine are hot and we don't mean the sexy kind.

I got the serial number off of the refrigerator and while it was not made in 1945 like the toilet lol, it is way overdue for replacement. Too bad they did not replace it yet. I expect they'll just ignore as they did when the bed bug beagle guy stated his dog found bed bugs in my apartment. Don't worry they will be getting their due very shortly. A piece of cake. Its like swatting a fat slow bug. Splat!

I went to see about this less costly apartment on East 55th and I'm afraid it will not do. Too much diesel fuel and for heavens sake I counted 20 smokers standing outside loitering on that street. No it will not do! I will not tolerate another crappy community or landlord. Darn I have not yet put in my Community Board application lol its never too late if you've got what it takes, elastic brain muscle ;)
